Planning and Developement
Despite (or perhaps because of) the current political emphasis on the development of brown field sites development in the countryside is an important issue for many of our clients. For some it may be alternative uses of buildings or land within the current farm business. For others it may be the identification of redundant buildings, farm steadings or land for disposal. Alternatively, you may have been approached by a developer interested in purchasing part or all of your property.
The keys, which will unlock any development value your property may have, are the Structure Plan, the Local Plan and a valid planning consent. Land owners may wish to undertake the development themselves for their own use or sale, they may wish to sell once planning consent has been granted or they may choose to dispose of the site in its current condition. Davidson & Robertson Rural provide advice to clients on a variety of planning matters including change of use and development Options. We also provide assistance with achieving new planning consent including liaison with the Local Planning Authority.
We have considerable experience of advising on and negotiating the optimum structure and terms of Option agreements between prospective developers and landowners. These agreements provide for the future sale of land on largely pre-agreed terms and can include up front, staged, one off and top up payments. The terms of an Option agreement must be tailored to suit the requirements of the landowner and the circumstances of the site and our aim is always to negotiate the best possible terms for the clearest possible outcome for every client.
